Bank of America one of 5 banks to implement mortgage forgiveness program

Have a mortgage with Bank of America? Then Your bank is the first to step up.............. If you are one of the select few, you may receive a mailing soon from Bank of America
offering a mortgage relief package. As part of a recent settlement Bank of America is forced to offer to HUNDREDS OF THOUSANDS of their customers a mortgage forgiveness program. The details will be in the letter but in essence will forgive a part of the principal balance of their mortgage. Over 200,000 candidates will be eligible half the letters are being mailed this week and many more will be mailed later this year. According to the Department of Justice: If you are not a B of A customer do not get upset, there are 5 banks total included in this $25 Billion dollar lawsuit so your bank may be stepping up next. The National Mortgage settlement announced "The deal will reduce loans for only a fraction of those Americans who owe more than their homes are worth. It will also send checks to others who were improperly foreclosed upon. But the amounts are modest." for many in Hampton Roads this good news comes a little to late, but those who can benefit should be aware. The guidelines announced back in February were as follows: whose eligible must: Owes more on the mortgage than the property is worth today. Was at least 60 days behind on payments on January 31, 2012. Has a contractual monthly payment for principal, interest, property taxes, hazard insurance and any applicable homeowner association fees totaling more than 25 percent of gross household income. Has a loan that is owned and serviced by Bank of America, or serviced for another investor that has given the bank delegated authority to do such modifications. Hampton Roads Homebuyers Think outside the box when negotiating


Home Inspection addendums are not always about repair request. Some times it may be a call to get creative. In lieu of repairs you may want to:

Ask for a price reduction

Ask for a sellers credit towards closing cost (if your loan will allow it)

Ask for furniture

Ask for the sellers car

Ask for the sellers pet

Ok now I am being silly but you get the idea....... The bottom line is to think outside the box. sometimes there is not enough time for a repair before closing. Sometimes you do not trust the seller to correctly fix an item. It is times like these where thinking out side the box comes in handy.........

This can also be beneficial to a seller who is strapped for cash and does not have the money to make repairs or give credits. Find another item to negotiate thaat the buyer may benefit from.

However buyers, if you for-go a repair remember to address the item as soon as you can after closing especially if it is an item an inspector marked urgent for needing repair.

In the end be sure to go over the report carefully with the inspector so you can understand if there is any potential hazards.

If you are in the process of buying or selling most loans require a clear termite and moisture letter to close. Short Sales Foreclosure Resale Homes OH MY what is the difference


Are you wondering what is the difference between Foreclosures, Short Sales & Resale Homes For Sale?

Foreclosures- Take on a variety of types also termed Bank properties or REO real estate owned, this means a borrower has failed to make payments and the mortgage company has taken the property back. In some states a borrower has the right to redeem their property before it is sold to a new buyer (such as in VA) and some states allow a borrower to come back after a foreclosure sale to redeem their property. Depending what state you are in find out the rules............ Bank Properties/Foreclosures can be sold in a variety of ways from on the court house steps, through auctions, through online bidding, or thru brokers in the MLS (multiple listing service). Usually in most cases the property is to be sold as is with no disclosures.

Short Sales- A current owner needs to sale there home but owes more on their current loan balance then the property is worth. They negotiate a deal with bank to sell the home for less than they owe. The difference between the current loan balance and the new excepted price is called a deficient amount. The bank can agree to wave the deficient amount or depending on a owners assets the bank can ask for a deficiency judgment. This is usually a negotiated amount between Owner and Bank for lower than deficient amount. For buyers this can give you a chance to buy a home you normally could not afford. But becareful of teaser sales prices-often agents price short sales low to attract an offer. A Bank usually wants a fair percentage based off current market value. If you need closing cost assistance this may end up being a hurdle because there is NO equity in the home so if the bank says No and seller can't pay it- your deal will be in the toilet............

Resale homes means a current real person seller exist. This seller can occupy the home or not occupy the home. It can be an investor or Flipper or a regular owner.

Be careful of flipped homes - just because it is remodeled does not mean it has been done correctly. Resale homes giv the buyer a chance to negotiate the small stuff, closing cost, repairs, home inspections, closing periods, Home Owners association or condo paperwork, or posession agreements. These little things often call contingencies and are usually not allowed in the negotiations for foreclosures and can be limited in short sale transactions.

Your loan type can dictate which properties you can choose from. Certain loans must meet minimum property standards for the lender to give the money. If you do not know which route you should look at give me a call and I can help guide you thru the process.

Its Leap Year Leap to Buy a Home


Sitting on the fence wondering if you should buy a home. Take the Leap of faith. With interest rates starting at 3.75% and up and the best inventory in years it would be ashame to let the opportunity slip by you.

First - Leap into getting pre-approved- through a reputable lender that will supply you with a copy of your tri-merge credit report. Be sure to address any errors, problems, or discrepancies up front.

Second - Decide on your needs vs wants and develop your search criteria (bedrooms, baths, amenities, etc...). This may include creating a reasonable well thought out budget for your new home payment (PITI- principal, interest, taxes, and insurance) and try paying yourself that payment for a few months to see if you can handle it. Hampton Roads Condo Buyers and SellersListen Up


VA Realtors have a new tool they can use to check for FHA approved condo complexes.

VAREALTOR.com/condocheck enter zip code or city state and get your answers

In May 2011 every condo complex was de certified and forced to reapply for FHA condo certification status. We are finding most became re-certified but a few have not. What ever the reason according to the Virginia Association of Realtors, "the end result is that buyers who want a unit in the un-certified condos are ineligible for FHA financing-something many seller don't discover until late in the process when they learn that their pool of prospective buyers has shrunk considerably....and because the certification process can take months deals fall through. "

Buyers if you are planning to use FHA financing have your agent check the status of the complexes you want to view preferably before your first initial visit.

For a condo to meet FHA loan guidelines it must:

At least 50% of the units must be owner occupied

Have specific Insurance coverage

No more than 25% of the property's total floor area can be used for commercial purposes ( so mixed used developments will not usually qualify)

No more than 10% of units can be owned by more than 1 person or entity.

No more than 30% can be financed by FHA

No more than 15% of the total units can be delinquent on their dues more than 30 days past due.

At least 50% of unit in complex sold. (Can not have more than 50% vacancy)

Must maintain a budget with sufficient funds for maintainace of the common areas and required condo project.

Virginia Real Estate Investors Think Big like the big wigs


3 Virginia Beach Real Estate Stocks were voted best stocks according to StockScounter's February report.

The Scouter score is based on how the stock performs in the following criteria: business fundamentals, price behavior, valuation and stock-ownership characteristics appear to predict a rising price in the coming weeks, based on how those factors have influenced stock prices in the past. REIT's- are usually formed to finance luxury condo and apartment ventures, strip malls, shopping malls, and commercial buildings that generate income from rents.

Real Estate investment Trust (REIT)- according to Wikepedia- a REIT is a company that owns, and in most cases operates, income-producing real estate. Some REITs finance real estate. To be a REIT, a company must distribute at least 90 percent of its taxable income to shareholders annually in the form of dividends. This is a great way for the girl next door to buy a piece of the shopping mall down the road or gain a profit from the high rise being built down the street. Why not own your condo and a peice of the whole block. When investing in a REIT -you need to think big.

Hampton Roads Sailors amongst the ERB Military hate to toss their homes away


In the last few weeks since Christmas I must of had a dozen calls from Hampton Roads Navy personnel who received pink slips and are now scrambling to figure out what to do with their homes. Many Norfolk Sailors who were let go as a part of the Navy’s enlisted retention boards layoffs are now trying to figure out what is next for them. If you have not heard Navy.mil reported that “a total of 2,947 sailors were given pink slips by the Navy late last year as part of an effort to reduce personnel in 31 overmanned ratings.”
Sources told the Navy Times that only a fraction of those sailors — roughly “300 to 350” will actually qualify to retire through the 15-year option. So if only roughly 300 sailors who were cut through the fleet’s enlisted retention boards will receive the new, early 15-year retirement option recently approved by Congress. What happenes to the other 2600 if they can not find new employment?
These are a few of the questions I have had
1. How do I sell a home that is worth less than my mortgage balance?
2. How do they pay their mortgage or even rent a home with no employment?
3. How can they find out if they will qualify for a short sale?
4. If they took the Tax credit and it hasn’t been three years do they have to pay it back or pay taxes on it?

This is just a few questions ERB Sailors will be asking me and others as their official departure day draws closer.
I spoke to one sailor who said “When reenlisted in the Navy I thought my contract would be honored for the 4 years I re-listed for and I planned my life and bills accordingly. I never thought I would be forced out and amongst the unemployed.”
I spoke to another sailor that says ” My only hope for employment is to leave the area I must consider selling my current home even if it means as a short sale.”
Most bought their home with a VA loan but each lender and loan type has its own guidelines for short sales so it is not a 1 + 1= 2 situation
